Umno 'kingmaker' spoils the party

Posted: 26 Sep 2013 08:11 PM PDT

I share Tun Faisal's disappointment when his bid to contest the Umno Supreme Council seat was illogically rejected by the party's technical committee two days ago. What happened to Umno transformation program?

I remember PM and party president Datuk Seri Najib saying that even an ordinary member can contest the No.1 post.

However, the technical committee says otherwise, that those vying for the MT seat must at least has held a position at divisional level. True, maybe but Tun Faisal was once a Pemuda Exco member, a position much supremo than any division.

I am flabbergasted with the manner Umno technical committee members imposing their self-regulated provisions for party election. All of them have been there for quite sometime but still lack of conscience over such matters.

Its time to change them with a new lineup, I suppose! Why? They are turning Umno into an undemocratic party by running the committee by their whim and fancy!

However, I am glad that Pemuda chief Khairy Jamaluddin has stood up for Tun Faisal, defending the latter's rights to contest the MT seat and questioning the decision by the technical committee.

Those who form the technical committee are playing kings to Umno. Just like the Disciplinary committee that picks one or two who breached the party's 'law' in order to show that they do their job fine enough.

There are so many 'tigers' and 'lions' in Umno of late, people who tried to control the members from within their respective office.

I am not stigmatising them but sometimes these people feel they are free of any error, and as such whatever decision they made cannot be contested. Just because they have been there too long enough, they know every aspect of the party.

And don't talk about amendment to the constitution to me because I believe I know more than you people up there.

Tun Faisal was involved in the party's transformation program 4 years ago, working alongside Umno vice-president Datuk Seri Hishammuddin Tun Hussein. I remember it very well. Hisham was head of the team at that time while his officer Harrison was tasked to assist.

Being the head of Pemuda New Media Team (UMB), Tun Faisal has been on the front line in formulating strategy for Umno and Barisan Nasional to cripple the opposition's onslaught during the 13th general elections.

In many aspects, he is much better than Umno information chief Ahmad Maslan and the people who head JASA and Jabatan Penerangan!

Sometimes our 'stupid' regulation may adversely affect Umno's aspiration to see young and talented leaders from going up. Some potential candidates had to be shown the exit on 'technical ground', something that is beyond comprehension.

'Kecil jangan disangka anak, besar jangan disangka bapak' is the right Malay proverb Umno must subscribe if we want to see more Tier-1 young candidates find their way up, and those who are already 'too old' for the party's various committees should be replaced.

I believe Tun Faisal has submitted his letter of appeal to the committee and I hope those 'uncles' will re-open the door for him to contest.

MACC must observe limitations

Posted: 26 Sep 2013 07:18 AM PDT

The Dewan Rakyat was today told that the government had never given the MACC (Malaysian Anti-Corruption Commission) the full power to prosecute those involved in graft as it would be unwise to leave the Attorney-General out of the legal process.

This means, the MACC should focus more on conducting investigation and not by any means try to influence or advice the public prosecutor on the sentence, bail or fine to be imposed.
KUALA LUMPUR, Sept 26 — Putrajaya today maintained its position in not giving the Malaysian Anti Corruption Commission (MACC) full powers to charge suspects, in the interest of maintaining a "check and balance" in the nation's criminal justice system.
Minister in the Prime Minister's Department Nancy Shukri said it would be unwise to leave the Attorney-General out of the legal process, as the MACC's judgement could be biased if it were to prosecute cases that it had investigated.
"If the MACC, which is an investigating agency, is given power to decide on prosecuting cases that it is investigating, then there would not be independence of mind in considering the facts and statements of a case objectively," she said in a written parliamentary reply to Gelang Patah MP Lim Kit Siang.
Nancy said the Royal Commission of Inquiry into the 2008 death of political aide Teoh Beng Hock while in MACC custody, came to the same conclusion that giving the anti-graft body full powers of prosecution would not improve the existing system.
"The Royal Commission was also of the view that the deputy public prosecutor that deals with the MACC should be stationed physically far from the MACC so that they are more free and not influenced by MACC officers at the workplace.
"The Royal Commission at the same time recommended the omission of subsection 5(6) of the Malaysian Anti Corruption Commission Act 2009 which gives the powers of a deputy public prosecutor to the MACC chief commissioner," she said.
Maybe Nancy should also seek the AGC to review some cases, especially 'unjust' jail terms and fined already imposed on those found guilty by the court.

For instance, its really beyond comprehension how a senior government officer convicted of graft is only sentenced to one day jail while a policemen or a low-rank public servant have to spend between two to 20 years in jail!

The MACC too must review its method of investigation by taking into account one's dignity and morale value. Any suspect or witness should be summoned to any MACC office to help investigation.

Unless they fail to turn up with valid reasons, then the MACC has every right to find them at their house or workplace. Even this method needs a lot of positive consideration as it may affect their good image.

The whole nation must also give strong support to MACC effort in combating corruption. However, as one of those who support them, I think there are rooms to improve MACC image in the public eyes, especially the appearance of their enforcement officers (who are too obsessed by the power entrusted to them).

A good PR is vital in expediting such duties... and don't be power-crazy!

PS - is there are justification or clause that permits the MACC to handcuff suspects who give full cooperation?
