Gani hits back

Gani Patail today hits back at his critics that the Attorney-General Chambers (AGC) is weak, incapable and corrupt in handling high profile cases.

Rubbishing such allegations as unfounded and unsubstantiated, the attorney-general said the prosecution division of the AGC had never ignored any single case, including the ones involving VVIPs, and that the chambers took note and fully appreciated the concerns of the general public.

He pointed out that whether a certain person is charged, depended solely on whether there existed sufficient evidence to prove the charge against the accused.

"Upon charging, Deputy Public Prosecutors will then present the available and admissible evidence to prove the prosecution's case. What has to be stressed here is that no evidence necessary to prove the charge will be left out.
"The duty to tender all evidence also includes the calling of all essential witnesses. This however is wholly dependent upon the availability and cooperativeness of the witnesses in giving their testimony in court," stressed Abdul Gani in a media statement, today.
He further pointed out that whether a witness truthfully testifies, however, was not within the power of the prosecutors.
"What matters here is that we never embellish or fabricate evidence and what we ultimately do, should a witness turn hostile, is to impeach him and in turn charge him for perjury," added Abdul Gani.
He said it was also necessary to reiterate that once all evidence of the prosecution case were presented, it was then left to the court to decide on whether the charge had been proven against the accused.
"How and what the courts decide is a matter beyond our control and power. Nevertheless, if we are of the view that the decision is flawed, we will exercise our right to appeal," assured Abdul Gani.
On the appointment of deputy public prosecutors, he explained that cases were assigned to Deputy Public Prosecutors (DPPs) according to the complexities and intricacies present in the case at hand, whereby cases which involve a higher degree of complexity will be handled by senior DPPs.
In the media statement, Abdul Gani also touched on the difficulties faced by the AGC especially in high profile cases, including the Mongolian woman murder case where the main grounds of acquittal by the Court of Appeal were the non-directions of the trial judge on issues raised by the appellants and the non-calling of DSP Musa Safri.
He said that while respecting the Court of Appeal, non-direction or misdirection of the trial court should not be attributed to the prosecution "as it had nothing to do with the conduct of the prosecution".
He said that the AGC maintained that Musa's testimony sheds no relevance to the narrative of the prosecution's case.
"Hence, this Office has filed an appeal to the Federal Court," he said.
Meanwhile, on the acquittal of former Transport Minister Tun Dr Ling Liong Sik on a cheating case based on testimonies of two ex-ministers and former prime minister Tun Dr Mahathir Mohamad, Abdul Gani said the court had held that there was no element of concealment, deception, misrepresentation or inducement on the part of the accused in regards to the purchase of the said land.
"This ruling was evidently a finding of fact based on the credibility of the former ministers.
"The Court ruled that based on the former ministers' interpretation, it was highly unlikely that the Cabinet had been falsely induced to approve the purchase of the land," said Abdul Gani, adding that it would be trite to appeal the decision as it would be difficult to argue that the Court had erred in its finding of fact. -- BERNAMA

MCA to team up with Dong Zong

Who says its not right for MCA to rub shoulders with Dong Zong? And who says SRJK (Cina) and SRJK (T) will be closed to pave the way to the national single education system (as proposed under the Razak Report)?

The vernacular schools are here to stay, whether the Malays like it of not. PM Najib will not second any proposal for their gradual 'shutdown'. Its against the Federal Constitution!
PETALING JAYA (Jan 2, 2014): MCA president Datuk Seri Liow Tiong Lai says the party will reopen dialogue with Dong Zong and Jiao Zong to close the gap between them for the betterment of Chinese education.
The newly-elected party chief admitted that MCA and Dong Zong (United Chinese School Committees Association) had antagonised each other in the past due to their differences on interpretation of the outlook for Chinese education.
He explained that from MCA's perspective, things are looking up for Chinese education (in the country) but Dong Zong sees it differently, believing that the road ahead is getting more bumpy and that Chinese primary schools are heading for extinction, thus the campaign to save them.
He told Sin Chew Daily in an interview published today that Chinese education has enjoyed stable development, including getting included in the National Education Blueprint and Education Act.
He pointed out that 1996 was the turning point for Chinese education when, during the tenure of then education minister Datuk Seri Najib Abdul Razak, Chinese education came under the Education Act 1996 following amendments to the Education Ordinance of 1956 and the Education Act of 1961.
"The education minister then is now the prime minister. Najib will not abolish Chinese education," said Liow, with an apparent reference to the fear expressed by Dong Zong.
Recalling his days in the Cabinet during discussions on the proposed National Edcuation Blueprint, he said the prime minister agreed with and accepted MCA's request for Chinese education to be included in the blueprint.
It was emphasised that the development of Chinese education was among the promises made among our forefathers in the formation of Malaysia and that it should remain part and parcel of the national education system.
They are doing it for the sake of Chinese education.

To those who have been dreaming about a 1Sekolah, better accept the fact that what we have right now is the actual 'national education system'. So, better drop the 1Sekolah idea.

Lets attend to our 'respective' schools, instead of complaining about others. 'Kalau nak belajar, belajar betul-betul laaaa!'

Just something to show to TURUN organiser. What they did they other day could lead to what is happening in Thailand today - its stocks market and the baht currency took a plunge!

If they want everything to TURUN, they may continue.

(Reuters) - Thai stocks and the baht currency tumbled on Thursday as uncertainty deepened about a February election that anti-government forces are determined to block in their bid to oust Prime Minister Yingluck Shinawatra.
The benchmark index dropped 2.7 percent to a four-month low of 1,263.72 before the midday break and the baht lost for a 10th straight day against the dollar. Investors are worried a February 2 poll will not go ahead, leaving Yingluck's government exposed to prolonged attacks by opponents.
National Security Council chief Paradorn Pattanatabut said on Thursday security agencies were considering declaring a state of emergency after protesters said they would try to "shut down" the capital from January 13.
"The situation has intensified," Paradorn told Reuters. "We may need to call for tougher measures and security agencies have planned for that."
The latest bout of political tumult erupted in November after a blunder by the ruling Puea Thai Party, which tried to push through an unpopular amnesty bill that would have annulled the jail sentence of Yingluck's self-exiled brother and former premier, Thaksin Shinawatra, the divisive tycoon at the heart of eight years of on-off conflict.
Protesters say Yingluck is a puppet of Dubai-based Thaksin, who they call a corrupt crony capitalist who has subverted a democratic system that needs to be suspended and overhauled.
TURUN almost shut down Kuala Lumpur on the eve of New Year. Imagine this happens to us here in Malaysia.
BANGKOK: Anti-government protesters plan to "shut down" Bangkok from January 13, deepening the crisis threatening the government of prime minister Yingluck Shinawatra.
Protest leader Suthep Thaugsuban says protesters will block the city's key intersections for up to a month, while some of his supporters say they will gather outside the homes of key government figures, preventing them from leaving.
Yup! No alarming impact on our local market, not just yet, and the ringgit was trading slightly lower than the US dollar today, according to Bernama.

Unless TURUN wants the ringgit to take a doom, they will see everything will NAIK and go up. Then it would be another story - Malaysians themselves will have TURUN to blame!
